Sri M. D. Mishra, learned counsel for the petitioner submits that an auction for grant of fishery lease in respect of Gaon Sabha pond on plot no. 1340 was held on 2.2.2006 in which the petitioner was the highest bidder and papers for grant of approval were sent to the S.D.O. but the same are pending consideration of the S.D.O. and he has not passed any order in respect of approval or disapproval. It is submitted by the petitioner's counsel that the approval has been granted to the auction of the other four ponds held on the same day in pursuance of the same publication and Munadi. It is also submitted that the petitioner has filed a representation-dated 24.4.2006 to the Pargana Adhikari, Naugarh, Siddharth Nagar but no order has been passed thereon and it is submitted that a direction be given to decide the representation.
I have heard the learned Standing Counsel and Sri Anuj Kumar who represents the respondent no.3.
Without expressing any opinion upon the merits of the petitioner's case the writ petition is disposed of finally with the direction to the S.D.O., Naugarh, Siddharth Nagar to pass appropriate orders on the representation of the petitioner expeditiously and if possible within a period of four weeks from the date a certified copy of this order along with a true copy of the representation is filed by the petitioner before him.
Copy of this order be made available to the learned counsel for the parties on payment of usual charges within three days.
