Heard learned counsel for the applicant and learned A.G.A.
It is contended by the learned counsel for the applicant that an application under Section under Sections 156(3) Cr. P. C. has been moved. On the basis of the allegation made therein prima facie cognizable offence is made out, even then the learned Magistrate has not directed the police station concerned to registered the case and investigate the same and that application has been treated as a complaint and the applicant has been directed to appear before the court concerned for recording her statement under Section 200 Cr. P. C. The impugned order dated 25.4.2006 is illegal.
Issue notice to opposite party no. 2 returnable within a period of four weeks
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and learned A.G.A. the operation of the impugned order dated 25.4.2006 shall remain stayed till the next date of listing.
List in the 1st week of August, 2006.
