HIGH COURT OF JUDICATURE OF ALLAHABAD

HON'BLE UMESHWAR PANDEY, J.

Heard the learned counsel for the petitioners.

Petitioners' suit was decreed exparte by the trial court on 6.12.1999. Respondents-defendants moved an application under Order IX Rule 13 C.P.C. for setting aside the exparte decree and restoration of the suit on 21.4.2000. The trial court as well as the revisional court have allowed the restoration application and have set aside the exparte decree passed in the suit and, therefore, sitting in writ jurisdiction I do not propose to interfere into the matter.

The petition does not appear to have any force and is hereby dismissed.
