This application is filed by the applicant Hem Raj Tyagi with a prayer that a direction may be issued the courts below for disposal of the bail application of the applicant expeditiously if possible on the same day in case crime no. 964 of 2005, under Sections 302, 394, and 411 I.P.C., P.S. Chandi Nagar, district Baghpat.
It is contended that the applicant that the applicant is not named in the F.I.R. and there is no credible evidence against him. is a peace loving and law abiding person and the applicant wants to appear before the court concerned, but there is reasonable apprehension in his mind that in case he appears before the court concerned and applies for bail his bail application shall not be considered and disposed of on the same day, so a suitable direction may be issued to the court below.
Considering the facts and circumstances of the case and submissions made by the learned counsel for the applicant it is directed that in case the applicant appears before the court concerned within 30 days from today and applies for bail his bail application shall be considered and disposed of expeditiously in accordance with the provisions of law. If any NBW is issued against the applicant the same shall be kept in abeyance for 30 days only from today.
With the above direction the application is finally disposed of.
