This application is filed by the applicant Lalit Prasad Sharma with a prayer that the further proceedings of the S.T. no. 28 of 2006, State Vs. V.C. Joshi and other, under Section 120-B and 420 I.P.C. and Sections 13(2)13(1) (d) of the Prevention of Corruption Act, 1988 pending in the court of learned Special Judge, C.B.I., Cases Anti Corruption, U.P. East, Ghaziabad may be quqshed.
From perusal of the record it appears that on the basis of the material collected by the I.O. during the investigation a prima facie offence is made out against the applicant, therefore, the prayer for quashing the further proceedings of this case is refused.
Considering the facts and circumstances of the case and submissions made by the learned counsel for the applicant it is directed that in case the applicant appears before the court concerned within 30 days from today and applies for bail the same shall be considered and disposed of expeditiously in accordance with the provision of law.
With the above direction the application is finally disposed of.
