This application is filed by the applicant Paras Nath Yadav with a prayer that the charge sheet dated 31.8.2005 filed in case crime No. C-12 of 2005 , under Sections 419, 420, 467, 468, and 471 I.P.C. P.S. Shahganj, District Jaunpur pending in the court of Additional Chief Judicial magistrates, Court No. 5, Jaunpur may be quashed/
From the perusal of the record it appears that on the basis of the material collected by the I.O. prima facie offence is made out, therefore the prayer for quashing the charge sheet is refused.
Considering the facts that in pursuance of the order passed under Sections 156(3) the F.I.R. was registered and circumstances of the case and submissions made by the learned counsel for the applicant and learned A.G.A. it is directed that in case the applicant appears before the court concerned within 30 days from today and applies for bail the same shall be considered and disposed of expeditiously in accordance with the provision of law. If any NBW has been issued against the applicant the same shall be kept in abeyance.
With the above direction the application is finally disposed of.
