This application is filed by the applicant Raheem Khan with a prayer to quash the order dated 25.1.2006 passed by the learned Additional Sessions Judge, ourt No. 14, Mathura in S.T. No. 362 of 2005, under Section 306 I.P.C., P.S. Sadar Baar, Mathura in exercise of powers conferred under Section 319 Cr. P. C.
From the perusal of the records it appears that on the basis of the statements of P.W. 1 and P.W. 2 the applicant has been summoned to face the trial. It also appears that there is general allegation against the applicant and other co-accused persons on which the applicant has been summoned, therefore, the prayer for quashing the impugned order dated 25.1.2006 is refused.
However, considering the facts and circumstances of the case and submissions made by the learned counsel for the applicant it is directed that in case the applicant appears before the court concerned within 30 days from today and applies for bail the same shall be considered and disposed of on the same day keeping in mind that the other co-accused persons have been released on bail in accordance with the provisions of law. If any NBW issued against the applicant the same shall be kept in abeyance only for 30 days from today.
With the above directions the application is finally disposed of.
