Suresh Kumar Shukla v. State Of U.P.& Others - WRIT - C No. 26839 of 2006 RD-AH 9840 (18 May 2006)
on'ble Yatindra Singh,J.
This is a writ petition for a direction to the respondents to grant a fair price shop licence to the petitioner on the ground that Gram Panchayat has already passed a resolution on 26.1.2005 in favour of the petitioner.
We have heard counsel for the petitioner and the Standing Counsel for the respondents.
According to the petitioner he has already given a representation dated 6.6.2005 to respondent no. 3. As it has not been decided, present writ petition has been filed.
In the circumstances of the case it would be appropriate that the petitioner's representation dated 6.6.2005 may be decided by the concerned authority by a reasoned order at an early date, and if possible, within three weeks from the date of receipt of certified copy of this order. The petitioner along with certified copy of this order will also file a copy of the aforesaid representation, other necessary documents and a duly stamped self addressed envelope. The concerned respondent after taking decision will communicate the same to the petitioner.
With these observations the writ petition is disposed of.
