Chunni Lal v. Board Of Revenue U.P. At Allahabad & Others - WRIT - B No. 27786 of 2006 RD-AH 9865 (19 May 2006)
Court No. 5
Civil Misc. Writ Petition No. 27786 of 2006
Chunni Lal ... ...... ......... Petitioner
Board of Revenue U.P. at Allahabad
through its Chairman and others ............ Respondents
Hon'ble Janardan Sahai, J
Counsel for the petitioner submits that a patta was granted to the petitioner for a period of 10 years and while the patta was subsisting another patta was granted in favour of respondent no.4 on 18.3.2005, which was therefore illegal. The petitioner filed a revision before the Board of Revenue against the order dated 18.3.2005. The Board of Revenue held that the petitioner's patta was cancelled on 26.6.2004 and that respondent no.4 was granted a patta for a period of one year which was approved on 2.5.2005. It has been found that revision against that order dated 18.3.2005 was not maintainable. There is nothing to show that the petitioner has challenged the order dated 26.6.2004 by which the petitioner's patta was cancelled. The one year term of the patta of respondent no.4 is already over. The findings recorded by the Board of Revenue do not suffer from any error, which may call for interference. The petition is dismissed.
