The counsel for the petitioner submits that:
(1)The petitioner was appointed as dealer on 26.12.1988 by Indian Oil Corporation ( Para no. 3 of the writ petition ) and respondent no. 4 was appointed as dealer in June, 2002 (Para 21 of the writ petition) and as such no benefit of paragraph 3.1 of the G.O. No. 1646/29-7-33 (K.O.)/90 dated 16.5.90 is available to respondent no. 4.
(2) Respondent no. 4 is not earlier appointed agent and is not entitled to sell oil directly to the retailers.
(3)There is no provision of appeal against reduction of quota under clause 10 of the U.P. Kerosene Control Order, 1962.
Notice on behalf of respondents no. 1 to 3 has been accepted by the Standing Counsel.
Issue notice to respondent no. 4 by Registered Post.
List this petition for admission after service upon respondent no. 4.
Till further orders of this Court, operation of the impugned order dated 13.4.2006 shall remain stayed.
