Criminal Misc. Bail Application No. 9526 of 2006 in case Crime No. 1 of 2006 under section 307 I.P.C. and Criminal Misc. Bail Application No. 9527 of 2006 in case Crime No. 3 of 2006 under section 25 Arms Act, Police station Bithauli, district Etawah moved on behalf of the applicant Pradeep alias Chhotu are being disposed of by a common order.

Heard Sri B.B. Dubey, learned counsel for the applicant, the learned AGA and have perused the record.

On 13.1.2006 at about 5 p.m. the applicant and co-accused are said to have opened fire at the police party. The police party had a narrow escaped. On personal search of the applicant a country made pistol .315 bore with an empty cartridge in its barrel and two live cartridges were recovered.

It is a case of no injury. There are no public witnesses to the recovery. The applicant has been granted bail in case Crime No.  5 of 2006 under section 41/411 I.P.C. by the learned Sessions Judge. In view of these facts, I consider it to be a fit case for grant of bail.

Let the applicant Pradeep alias Chhotu involved in case Crime No. 1 of 2006 under section 307 I.P.C. and case Crime No.  3 of 2006 under section 25 Arms Act, Police station Bithauli, district Etawah be released on bail on furnishing personal bond with two sureties  each in the like amount  to the satisfaction of the court concerned.
