This writ petition has been filed raising the grievance that the State Government has not performed its statutory duty under Section 23 of the Waqf Act as the post of Executive Officer in U.P. Sunni Central Waqf Board, Lucknow is lying vacant and no appointment is being made and, therefore, the working of the Board is suffering.
After hearing Shri M.A. Qadeer, learned counsel for the petitioner and Syed Mahmood, learned counsel appearing for respondent, we dispose of the writ petition requesting the respondent no. 1 the learned Secretary, Minority Welfare and Muslim Waqf, Lucknow to perform its statutory duty by appointing the Executive Officer of the Board expeditiously, preferably, within four weeks from the date of filing a certified copy of this order before him.
