1. One Anand Kumar Singh was a fair price shop licensee. His licence was cancelled. Thereafter he filed an appeal. During pendency of the appeal, the petitioner was granted a fair price shop licence. Subsequently, the appeal of Anand Kmar Singh was allowed on 28.4.2006. The petitioner has filed writ petition no. 25102 of 2005 against the order dated 28.4.2006. In this writ petition, no interim order has been granted. Thereafter, by the order dated 12.5.2006 supply of essential commodities to the petitioner has been stopped.
2. `We have heard counsel for the petitioner and standing counsel for the respondent. The petitioner was granted licence during pendency of the appeal of previous licencee. The licence of the previous licensee has been restored by the appellate court. In view of this, there is no merit in the writ petition. However, in case any interim order is granted in WP No. 25102 of 2006 or any final order is passed therein, it would be open to the petitioner to seek modification of the order dated 12.5.2006 passed by respondent no. 2.
3. With these observation, the writ petition is dismissed.
