Supplementary affidavit filed today be kept on record.
Heard Sri Ajai Singh holding the brief of Sri Birendra Singh, learned counsel for the petitioner and learned Standing Counsel for the respondents.
The petitioner was granted a mining lease on 31.8.1995 for a period of ten years but he was not permitted to run the mines for a period of 2 years 9 months and 9 days. He has moved a representation on 29.11.2006 before the respondent no.2, District Magistrate, Mahoba for extension of mining lease, which is annexed as Annexure no.3 to the writ petition. In support of his submission, learned counsel for the petitioner has relied upon a decision of the Apex Court in the case of Beg Raj Singh Vs. State of U.P. & others reported in AIR 2003 SC 833.
In the facts and circumstances of the case, we direct the respondent no.2, District Magistrate, Mahoba to decide the aforesaid representation of the petitioner within a period of 3 weeks from the date of filing of a certified copy of this order, taking into consideration the aforesaid decision of the Apex Court.
With the aforesaid observation, the writ petition is disposed.
