Heard counsel for the petitioner. Sri A. N. Tiwari appears for the respondents No. 2,3 and 4. Learned standing counsel appears for the respondent no. 1.
By this writ petition the petitioner has prayed for mandamus commanding the respondents to payment of all retiral benefits (provident fund, gratuity, leave encashment and Insurance) including 15 months salary with interest.
Petitioner's case in the writ petition is that the petitioner's wife Mata Dai was working as Safai Karmchari in Nagar Nigam, Varanasi who died on 24.4.2004. The petitioner has submitted a representtion before the respondent no. 2 praying for payment of the benefits consequent to the death of the wife of the petitioner. Copy of the said representation dated 2.2.2007 has been filed as Annexure-3 to the writ petition. In the facts of the case ends of justice be served in disposing of the writ petition directing the respondent No. 2 to consider and take appropriate decision on the claim of the petitioner for payment of death-cum-retirement benefits of petitioner's wife expeditiously preferably within a period of three months from the date of production of a certified copy of this order .
With the above observations the writ petition is disposed of.
