Heard Sri Madhav Jain, learned counsel for the petitioner and Sri Prakash Padia, learned counsel for the respondents.
The petitioner is carrying on the business of petroleum products. The supply has been suspended by the respondents on certain allegations in respect thereof show cause notice has been issued. The grievance of the petitioner is that the reply to the show cause notice has been submitted but no decision has yet been taken by the respondents and the supply has not been restored. Sri Prakash Padia, learned counsel for the respondents submitted that there is no evidence that the reply to the show cause notice has been filed. However, he submitted that in case, if the petitioner files a reply to the show cause notice, the same may be considered expeditiously.
In view of the above, we dispose of the writ petition that in case if the petitioner files a reply to the show cause notice within a period of one week from today, the respondent is directed to dispose of the reply by a speaking and reasoned order after giving opportunity of hearing within another three weeks from the date of filing of certified copy of the order before the authority concerned.
