An order was passed for correction of map by the Consolidation Officer regarding position of plot nos.29 and 30. An appeal against that order was preferred by the respondents Shiv Murat and Others, which was allowed. The finding is that the appellants in the appeal were not heard. A revision against that order was filed by the petitioners which has been dismissed. Counsel for the petitioners submitted that the order which was passed is dated 15.1.93 and there was no order dated 13.1.93 against which appeal was filed. A copy of the memo of appeal has been filed which indicates from the contents that it relates to the order of the Consolidation Officer which was for correction of position of plot nos. 29 and 30 in the map. The Settlement Officer Consolidation has considered the question regarding the date of the Consolidation Officer's order and he found from the file that there was some confusion about the date of the Consolidation's order which appeared to be 15.1.93. However even if a wrong date is given, it would not affect the validity of the appellate order as the appeal was filed against the order of the Consolidation Officer changing the position of the plots in the map. The finding is that the respondents were not heard. Opportunity has been given to the petitioners also to put forth their version. No ground for interference under Article 226 of the Constitution of India has been made out. Dismissed.
