Heard Sri Satya Prakash, learned counsel for the petitioner and Sri Satish Chaturvedi, learned counsel appearing for the respondent no. 5.

Since the petitioner has equally efficacious alternative remedy by approaching the U.P. Public Service Tribunal under the provisions of the Act and also  since the disputed questions of fact involved in the matter may be adjudicated upon there, we decline to interfere with the orders impugned in the writ petition at this stage in exercise of extra ordinary jurisdiction under Article 226 of the Constitution of India without entering into the merits of the case.

The writ petition is, therefore, dismissed on the ground of availability of alternative remedy.
