Sri Ajay Singh, learned counsel for the respondent has raised a preliminary objection that since no cause of action has arisen within the territorial jurisdiction of this Court, this writ petition would not be maintainable. In support of his contention, he has placed reliance on a Full Bench decision of this Court in the case of Rajedra Kumar Mishra Vs. Union of India and others (2005)1 U.P.L.B.E.C. 108. Learned counsel for the petitioner does not dispute the fact that the petitioner was posted is Jummu and Kashmir and no cause of action has arisen within the territorial jurisdiction of this Court.
In view of the aforesaid facts and the ratio of the aforesaid Full Bench decision of this Court, this writ petition is dismissed. However, the petitioner shall be at liberty to approach the competent court for redressal of his grievances.
