Prasidh Narain Singh v. Sub Divisional Officer Sagari & Others - WRIT - C No. 25411 of 2007 RD-AH 10170 (25 May 2007)
Hon. Sunil Ambwani, J.
Heard learned counsel for the petitioner and learned Standing Counsel.
The petitioner has confined his relief for expeditious disposal of his election petition. A perusal of the order-sheet of the election petition filed in September, 2005 shows that the matter has been unnecessarily adjourned on several occasions. On some of the dates, the Advocates decided to abstain from judicial work and on some other dates the presiding officer was busy in administrative matters. In order to maintain peace and harmony the statutory election petitions should be decided expeditiously. The Sub Divisional Magistrate should try to devote more time to quasi judicial matters.
Having regard to the facts and circumstances of the case, the writ petition is disposed of with the directions that the Election Tribunal will decide the election petition expeditiously and if possible within four months without granting the unnecessary adjournments.
