HIGH COURT OF JUDICATURE OF ALLAHABAD

16-01-2007 Hon'ble S.P. Mehrotra, J.

On account of failure on the part of the learned counsel for the applicants in various Applications, mentioned in the order dated 23rd August, 2006 in taking requisite steps for issuance of notices on the said Applications, pursuant to the said order dated 23rd August, 2006, the case is listed today with the Office Report dated 15th January, 2007.

Civil Misc. Application No. .....,....of 2007 has been filed today.

Registry is directed to give appropriate number to the said Application.

It is submitted by the learned counsel for the applicants that while the Office Report shows that Postal Stamps regarding Registered Post A.D. at the rate of Rs. 40/- for each notice be submitted, the charges should, in fact, be Postal Stamps worth only Rs. 30/- for each notice.

Accordingly, the learned counsel for the applicants  submits that he is submitting Postal Stamps worth Rs. 420/- at the rate of Rs. 30/- for each notice, instead of Postal Stamps worth Rs. 560/- at the rate of Rs. 40/- for each notice, as required in the said Office Report dated 15th January, 2007.

In view of the said submission made by the learned counsel for the applicants, the concerned In-charge was summoned from the Second Appeal Section.

The said In-charge has stated that having regard to the fact that the learned counsel for the applicants is supplying copies of the Applications on the thin papers, Postal Stamps worth Rs. 30/- for each notice would be sufficient.

Accordingly, steps taken by the learned counsel for the applicants, as mentioned above, are accepted. .

Delay in taking steps is condoned.

Office is directed to proceed.

Notice will now be issued fixing 24th May, 2007.

List on 24th May, 2007.

The aforementioned Application, filed today, stands disposed of accordingly.
