The Central Administrative Tribunal, Allahabad Bench Allahabad, by means of the judgment dated 29th August, 2006 dismissed the Original Application filed by the petitioner. It is against this order that the present writ petition has been filed.
The petitioner was working as a Driver in the Central Railway Jhansi when he failed to apply breaks in time and over shot the danger signal as a result of which he was issued a charge-sheet for acting in a careless and negligent manner. The disciplinary authority passed an order of compulsory retirement. The appeal filed against the said order was also dismissed. These two orders were challenged by the petitioner. The Tribunal has dismissed the Original Application holding that the petitioner had not only admitted his guilt in reply to the charge-sheet but had also submitted that he would accept any order that would be passed by the Authority and, therefore, if the petitioner had admitted his guilt, there was no occasion for the Disciplinary Authority to hold regular inquiry. We find no fault with the reasoning given by the Tribunal.
The writ petition is, accordingly, dismissed.
