In pursuance of our order dated 18.5.2007 the Deputy Inspector General of Police, CBI ACB, Lucknow is present. He has filed a status report which mentions that the order dated 12.3.2007 passed by this Court was placed before the Director CBI on 29.32007 and the Director, CBI transferred the investigation of the case from Special Crime Branch, Delhi to the present investigation team. He further mentions that copies of the orders dated 26.5.2006, 12.3.2007, 18.5.2007 and the investigation papers have been placed before the Central Vigilance Commission on 24.5.2007.
List this case on 13.7.2007 for submission of further progress report. We are not satisfied with the line of action adopted by the investigating team in this case. We hope that CVC will look intently into the orders and other materials placed before him and take a decision as to whether the investigation by the present team should be continued or another team should be appointed for the investigation, who can inspire greater confidence of the court. He may also take appropriate steps against the concerned investigating officers and others in case he thinks that there is any dishonesty or ineptitude in the conduct of investigation. He shall submit his comments on the line of investigation and material furnished before him on the next date of listing.
We also desire that Santosh Kumar Saha, photographer shall be present in this Court with all the photographs and C.D. of the case prepared by him on the next date of listing. Learned Government Advocate and counsel for the C.B.I. shall communicate this order to the CVC within one week.
Copy of this order shall be given to the learned counsel for the parties within 24 hours free of cost.
