Arun Kumar Singh And Others v. State Of U.P. And Others - CRIMINAL MISC. WRIT PETITION No. 6992 of 2007 [2007] RD-AH 10276 (30 May 2007)
|
Criminal Misc.Writ Petition No. 6992 of 2007
Arun Kumar Singh and others Vs. State of U.P. & others
Hon'ble S. Rafat Alam, J.
Hon'ble A.K.Roopanwal, J.
Heard learned counsel for the petitioners and also perused the impugned FIR.
The allegation in the impugned FIR prima facie discloses commission of cognizable offence and, therefore, we are not inclined to grant any relief to the petitioners.
The writ petition is accordingly, dismissed. However, it would be open for the petitioners to surrender before the court concerned and apply for bail in Case Crime No. 86 of 2007, under Sections 498-A,506 and 323 IPC and Section 3/4 of Dowry Prohibition
Act, Police Station George Town, District Allahabad. We have no doubt that in the event such an application is moved the same may be considered and disposed of expeditiously. Since the petitioners no.5 and 6 are ladies, their bail applications may be considered and disposed of, if possible, on the same day keeping in view the first proviso of Section 437 Cr.P.C.
