The sole contention raised by the learned counsel for the petitioner for quashing the order dated 16th May, 2007 that has been passed by the District Magistrate Kanpur Dehat in favour of private respondent no. 6 Mridula Dixit is that she is not a resident of Ward No. 7 and, therefore, could not have been appointed as a ''Shiksha Mitra'.
Admittedly the petitioner has only 55% marks to her credit as against 60.5% marks in favour of Mridula Dixit private respondent no. 6. The District Magistrate has recorded a categorical finding on the basis of the documents filed by the parties that private respondent no. 6 is the resident of Ward No. 7. There is no infirmity in the said finding recorded by the District Magistrate.
The writ petition is, therefore, devoid of merit. It is, accordingly, dismissed.
