By means of the present writ petition the petitioner has approached this court for issuing a writ of mandamus directing the respondent No.2 to dispose of the appeal No.44/2006 (Naresh Chandra Vs. State of U.P.) of the petitioner.
The petitioner who was a licensee of the fair price shop, it appears that on the basis of some complaint the license of the petitioner was cancelled by respondent No.4. Petitioner aggrieved by the aforesaid order of cancellation has filed an appeal on 27.7.2006. It has been submitted by the petitioner that the appeal is still pending and it has not yet been decided and date after date is being fixed by the appellate authority. The petitioner has also filed the copy of the order sheet which shows that the case is being adjourned from time to time without any reason.
In view of the aforesaid fact, the present writ petition is disposed of directing the respondent no.2 to decide the appeal filed by the petitioner within a period of six weeks from the date of production of the certified copy of the order.
With these observations the writ petition is disposed of.
No order as to costs.
