The main grievance of the learned counsel for the petitioner is that the Joint Director of Education, Gorakhpur Region, Gorakhpur is not affording adequate opportunity to the petitioner to place his version as he received the letter dated 14th May, 2007 only on 25th May, 2007 which was in fact the date fixed for his appearance before the Joint Director of Education. He, therefore, contends that the matter may be decided after affording him adequate opportunity.
The Joint Director of Education is proceeding to decide the representation filed by Sri Rama Shanker Singh pursuant to the directions issued by this Court on 1st March, 2007. The Court has no reason to doubt that the Joint Director of Education, Gorakhpur Region, Gorakhpur shall afford proper opportunity to the petitioner before passing any order. There is, therefore, no necessity to pass an order to the said effect. In any case, the petition is premature as the petitioner can challenge the order that may be passed by the Joint Director of Education, if the petitioner feels aggrieved of the said order.
The writ petition is, accordingly, dismissed as premature.
