Heard Sri Surya Narayan, learned counsel for the petitioner and Sri P.K.Singh, counsel for the Development Authority.
For the grievances of the petitioner, the petitioner has already filed a Suit No.341 of 2007 that is still pending. An application for injunction was filed and the ad-interim injunction was not granted, therefore, the petitioner has approached this Court. It has been submitted that due to Summer Vacation, the application of the petitioner is not being considered. If the matter is urgent, the civil court always entertain the application for ad-interim injuction.
In my opinion, as the civil suit is still pending and the rights of the parties have to be decided by the competent civil court.
The writ petition is not maintainable and is hereby dismissed.
