Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the alleged occurrence has taken place in the dark hours of night on 9.12.2005 at about 1.00 a.m. Its F.I.R. was lodged on 9.12.2005 at about 10.30 a.m. in which nobody was named. After four months of the alleged occurrence two persons have filed affidavits in which the allegation of committing the murder is made against the applicant. The naming of the applicant is after thought.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Jhau alias Jhabbuwa involved in case crime no. 324 of 2006 under Sections 302,120-B I.P.C.,and section 3(2)(5) S.C./S.T. Act P.S. Dhanali District Badaun be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
