I have heard Sri M.P.Yadav, learned counsel for the petitioner and Sri Manish Tripathi, counsel for the respondents.
As soon as the petitioner deposits a sum of Rs.1,00,000/- the Tractor No.U.P. 73-B 6724 be released in favour of the petitioner. It is further provided that second installment of Rs.1,00,000/- be paid by 30th August, 2007. Next installment of Rs.1,00,000 by 30th October, 2007 and rest of the amount by 1st December, 2007. In case of default made by the petitioner it will be open to the respondents Bank to initiate any proceeding or to cease the vehicle.
It is further made clear that in case the petitioner submits a representation for providing the details of deposits made by the petitioner and regarding the payment of interest, as the petitioner submits that loan was payable up to 2014 but now the petitioner in view of the order passed by this court will pay the total amount up to December, 2007. The respondents will also consider the fact regarding interest which is to be paid by the petitioner.
With these observations the writ petition is disposed of.
No order as to costs.
