The petitioner was transferred in March 2005 from Gyanvyapi Kashi Vishwanath Mandir, Varanasi to 34 B.N.P.A.C Bhulanpur Varanasi in the same district.

The petitioner, however, continued to retain the house allotted to him at Gyanvyapi Kashi Vishwanath Mandir, Varanasi. By the impugned order dated 18th April, 2007 the petitioner has been asked by the Senior Superintendent of Police Varanasi to vacate the said house.

The contention of the learned counsel for the petitioner is that the respondents have transferred him in the same district and even though they have not allotted any other quarter to the petitioner on his transfer yet they are asking him to vacate the premises allotted to him. The petitioner has also pointed out various difficulties that he would face and for the said purpose has moved an application on 17th May, 2007 before the Senior Superintendent of Police Varanasi.

After hearing learned counsel for the petitioner and the learned Standing Counsel for the respondents, this petition is disposed of with a direction that the aforesaid representation moved by the petitioner shall be decided expeditiously by the Senior Superintendent of Police Varanasi but till the decision is taken in the matter the petitioner shall not be compelled to vacate the premises.
