This petition has been filed against the recovery certificate.
Learned counsel for the petitioners has stated that the petitioners are ready to deposit the entire amount due under the recovery certificate.
Learned counsel for the respondent Bank has no objection to such deposits being made by the petitioners.
In view of the aforesaid, the recovery certificate shall be kept in abeyance provided the petitioners deposit the entire amount due under the recovery certificate in three equal instalments at an interval of two months in the following manner:-
(1) The first instalment shall be paid by 30.6.2007,
(2) The second instalment shall be paid by 30.8.2007 and
(3) The third instalment (including interest) shall be paid by 30.10.2007.
In case the petitioners fail to deposit any of the instalments, it shall be open to the respondents to give effect to the recovery certificate.
Learned counsel for the petitioner further states that two citations have been issued for the same loan-one to the husband and the other to the wife and if it is so, the petitioners shall be made liable to pay the amount under one citation.
Subject to the observations made above, the writ petition is disposed of.
