The petitioner had earlier challenged the demand notice dated 23.12.2006 issued bythe Chief Accounts Officer in the office of GMTD, NOIDA, district Gautambudh Nagar by filing Writ Petition No. 9848 of 2007 which was disposed of by means of the judgment and order dated 23.2.2007 requiring the petitioner to make the initial deposit of Rs. 50,000/- within one month from the date of the order and the balance amount in four equal instalments. The petitioner did not deposit the said amount within the period of one month and in fact he deposited the amount only on 23.4.2007. The Senior Accounts Officer thereafter sent a communication dated 30.4.2007 to the petitioner pointing out the aforesaid default and requested the petitioner to pay the balance amunt of Rs. 1,40,624/- together with 10% recovery charges. The petitioner did not do so, as a result of which the citation was issued.
In my opinion, this petition cannot be entertained as any order passed in this petition would amount to modification of the order earlier passed by this Court. The petitioner can move an appropriate application in the aforesaid writ petition which was disposed of on 23.2.2007.
Subject to the aforesaid observations, the writ petition is dismissed.
