Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. After nine days of the alleged occurrence the name of the applicant has been disclosed alleging therein that the deceased was having illicit relations with the aunt of the applicant. The applicant was named only on the basis of doubt and suspicion. There is no direct eye witness evidence. Nothing incriminating has been recovered from the possession of the applicant or at his pointing out.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Gajendra involved in case crime no. 104 of 2006 under Sections 302,201 I.P.C., P.S. Sikandarabad District Bulandshahar be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
