The petitioners seek the quashing of the order dated 4th June, 2007 passed by the Commissioner, Trade Tax, U.P.

Petitioner nos. 1 and 2 were serving in the Armed Police and Civil Police respectively and were transferred to the Trade Tax Department for a period of three years on deputation by the order dated 14th January, 2006 passed by the DIG Police (Establishment) while petitioner no. 3 who was serving in the Govt. Railway Police Force, Agra was also transferred to the Trade Tax Department by the DIG Police (Establishment) by the order dated 11th December, 2005 and when these petitioners went to the Trade Tax Department for joining, the order dated 4th June, 2007 was passed mentioning therein that it was not possible to accept the joining report as the orders had been passed in December, 2005 and January, 2006 asking the petitioners to join the Trade Tax Department.

Learned counsel for the petitioners contended that petitioner nos. 1 and 2 were relieved only on 21st May, 2007 while petitioner no. 3 was relieved on 23rd May, 2007 and so they could not have joined the Trade Tax Department earlier.

Learned Standing Counsel has suggested that the petitioners may approach the DIG Police (Establishment) by filing a detailed representation pointing out their grievance.

In view of the aforesaid, this petition is disposed of with a direction that in the event such a representation is filed by the petitioners before the DIG Police (Establishment) along with a certified copy of the order passed by this Court, the same shall be considered and decided in accordance with law expeditiously preferably within a period of three weeks from the date the representation is filed.
