This petition under section 482 Cr.P.C. has been filed to quash the complaint case No.2873 of 2006 and the order dated 6.4.2007 passed under section 204 Cr.P.C. whereby N.B.W. have been issued against the petitioners.
The allegations against the petitioners are that the summoning order against the petitioners was issued for the offence u/s 504 and 506 I.P.C.; that the petitioners were summoned on a complaint; that petitioner no.2 is a lady.
After having considered the nature of the offence and the facts and circumstances of the case I finally dispose of this petition directing that if petitioner no.1 Mohit Gupta surrenders in court below within 2 weeks and applies for bail his bail application be disposed of expeditiously in the light of the case of Smt. Amrawati and another Vs. State of U.P. 2004 Alld. Civil Journal Page 1846 and with the direction that if petitioner no.2 Smt. Madhu Gupta (who is a lady) appears in the court below within a week, she shall be released on bail on her executing a personal bond of Rs. 30,000/- and furnishes two sureties of the like amount. Meanwhile they will not be arrested and no coercive measures shall be adopted against the petitioners.
