At the point of time when the matter has been taken up, the question of amount to be recovered has not at all been disputed.
Sri Rama Shanker Shukla, learned counsel for the petitioner makes statement before this court that petitioner is ready to make full and final payment and he further submits that reasonable time be accorded to him.
Sri Ashok Bhatnagar, Advocate appearing for Bank on the other hand contended that he has no objection in case petitioner is ready to pay entire amount with Bank in question.
In these circumstance and this background, petitioner shall deposit 25% amount due towards loan with Bank-respondent no. 3 within eight weeks. After said amount is deposited, balance amount, which is due, same shall be deposited within next six months at the gap of every two months in three instalments. In the event of default facility extended shall automatically stand discharged. In the event of terms and conditions being complied with no coercive action shall be taken against the petitioner.
With these observations, writ petition is disposed of.
