Shiv Ram Singh & Others v. State Of U.P. & Others - WRIT - C No. 27322 of 2007 RD-AH 10612 (15 June 2007)
Hon'ble Sudhir Agarwal, J.
The grievance of the petitioner is that the respondent no. 3 is harassing the petitioner.
From para 7 of the writ petition it is evident that some FIR has been lodged by respondent no. 4 and in my view, if that so, it is the statutory duty of the Station House Officer or any person who is investigating the matter pursuant to FIR, to take all steps as permissible under law and if in discharging of his official duties, he has made any interrogation of any person including the petitioner, the same cannot be termed as harassment.
The writ petition is thoroughly misconceived and is dismissed with cost of Rs. 2000/- which shall be deposited with the Registrar General of this Court within a week, failing which the Registrar General shall take steps for realising the same from him as arrears of the land revenue.
