Heard learned counsel for the appellants, learned A.G.A. for the State of U.P. and also Sri Gaurav Kakkar, learned counsel for the complainant and perused the record.
Prayer for bail has been made on behalf of appellant No. 1 Riyasat Ali, Appellant No. 2 Etmad, Appellant No. 3, Mustar, Appellant No. 4 Ishaq and appellant No. 10 Anwar.
It is submitted by learned counsel for the appellants that the co-accused Masroor and Israr have already been released on bail by this Court. It is further submitted that there are cross cases in which both side sustained injuries.
Considering the facts and circumstances of the case and without expressing any view on merit, let the Appellant No. 1 Riyasat Ali, Appellant No. 2 Etmad, Appellant No. 3, Mustar, Appellant No. 4 Ishaq and Appellant No. 10 Anwar be released on bail on their executing a personal bond and furnishing two sureties each in the like amount to the satisfaction of the Court concerned provided 50% of the fine is deposited within a period of fifteen days from the date of their release, failing which the bail so granted to them shall stand cancelled.
Office is directed to prepare paperbook and list this Appeal along with Criminal Revision no. 371 of 2007 for final hearing at an early date.
