Heard Sri Vivek Kumar Singh and Sri Ajay Kumar Singh, learned counsel for the applicant and learned A.G.A. for the State of U.P. and also perused the record.
Parity is one of the ground for bail in this case about which it is submitted that the co-accused Mohkam has been enlarged on bail by this Court vide order dated 16.04.2007 passed in bail application No. 7717 of 2007 and since case of the applicants is at par, they should also be granted bail in this case.
On merit, it is submitted that the applicants are not in-laws of deceased Smt. Bharti Devi and they are not responsible for her suicide.
On the contrary, the bail has been opposed by learned A.G.A.
Having heard the parties' counsel and keeping in view the fact that the co-accused Mohkam has been granted bail by this Court, hence on the ground of parity and merit also, the applicants may be granted bail in this case now.
Let applicants, Hari Raj S/o Bheem Singh, Roop Basant S/o Ram Charan and Gudda S/o Hari Singh be released on bail in case crime No. 23 of 2007 under Sections 452, 323, 504, 306, 201 I.P.C. P.S. Anoopshahr, District Bulandshahr on their executing a personal bond for Rs.25,000/- and furnishing two sureties each in like amount to the satisfaction of the C.J.M. concerned.
