The father of the petitioner who was working as an Assistant Teacher in the LT grade in the Intermediate College died in harness on 25th March, 2006. It appears that both the petitioner and respondent no.5 who is the elder brother of the petitioner are claiming appointment on compassionate grounds and the matter is engaging attention of the District Inspector of Schools, Allahabad. Apprehension of the petitioner is that the District Inspector of Schools, Allahabad shall pass an order without taking into consideration the case of the petitioner for grant of compassionate appointment.
Learned Standing Counsel has suggested that the District Inspector of Schools, Allahabad shall pass an appropriate order after hearing both the petitioner and respondent no.5.
In view of the aforesaid, the petition is disposed of with a direction that in the event the decision has not already been taken by the District Inspector of Schools, Allahabad, he shall decide the matter relating to grant of compassionate appointment of the petitioner or respondent no.5 after hearing both the parties in accordance with law expeditiously preferably within a period of six weeks from the date a certified copy of this order is produced by the petitioner before the District Inspector of Schools, Allahabad.
