Heard Sri Mithilesh Kumar Shukla, learned counsel for the applicant and learned A.G.A. for the State of U.P. and also perused the record.
It is alleged that some poison was mixed in the chhola, which was served in the feast of barat on 18.02.2006.
It is submitted by learned counsel for the applicant that incident is said to have occurred on 18.02.2006, but the F.I.R. was lodged after great delay on 06.04.2006. It is further submitted that the applicant was only serving food in the barat.
The bail has been opposed by learned A.G.A.
Having heard the parties' counsel and keeping in view all the facts and circumstances of the case, the applicant may be granted bail in this case now.
Let applicant, Ninnoo @ Jitendra S/o Sri Nathu Ram Kushwaha be released on bail in case crime No. 107 of 2006 under Section 328 I.P.C., P.S. Dakshin, District Firozabad on his executing a personal bond for Rs.20,000/- and furnishing two sureties each in like amount to the satisfaction to the satisfaction of the C.J.M. concerned.
