     Pursuant to the order dated 18.6.2007, the case has been put-up today ,as an unlisted case.

Learned standing counsel states that he has received instructions in the matter.He  submits that according to the instructions received by him, the  Executive Officer , Nagar Panchayat , Handia, Allahabad made a complaint dated 29.5.2007 to the Prabhari Nirikshak, Handia, interalia, pointing out that under the garb of collecting parking fee at  the Taxi Stand in question, certain anti-social elements are charging Gunda -Tax, Tehbazari etc. illegally.

Learned standing counsel submits that in view of the said complaint lodged by  the Executive Officer, Nagar Panchayat , Handia, Allahabad , the Prabhari Nirikshak, Handia, has taken action to stop the collection of  Gunda Tax, Tehbazari etc. illegally under the  garb of collecting parking fee by the anti -social elements.

It is submitted by the learned standing counsel that no action is being taken by the Prabhari Nirikshak, Handia to stop the collection of parking fee by the petitioner under the  terms of the contract entered into between the petitioner and the Nagar Panchayat, Handia, Allahabad .

Learned standing counsel submits that no restraint has been put on the petitioner in collecting the parking fee in terms of the contract at the Taxi Stand in question.

Learned standing counsel further submits that no political pressure has been exercised by the Minister, as alleged in the Writ Petition.

Having regard to the facts and circumstances of the case, and having considered the submissions made by the learned counsel for the parties, it is directed that no interference  will be made by the respondent no.4 in  the collection of  parking fee by the petitioner at the Taxi Stand in question in accordance with the terms and conditions of the contract  till 27.7.2007, unless this order is vacated or modified earlier.

In case any violation of the terms and conditions of the contract has been committed by the petitioner, it is open to the Nagar Panchayat, Handia  to take appropriate action in this regard.

Copy of this order will be given to the learned counsel for the parties on payment of usual charges, today.
