Heard Sri Arun Kumar Singh, learned counsel for the applicant and learned A.G.A. for the State and perused the record.
It is submitted by learned counsel for the applicant that seal of envelope in which one paper was found short was intact and said envelope was opened in presence of five persons.
Next submission is that inquiry was made by S.D.M., Khekhada (Baghpat) and the applicant was not found at fault, but false F.I.R. has been got registered against him and without making proper investigation, chargesheet also has been submitted against the applicant.
Issue notice to opposite party no. 2 to file counter affidavit within four weeks. Rejoinder affidavit may be filed within two weeks thereafter.
List on 30.07.2007.
Till then, further proceeding of criminal case no. 1314 of 2006 (State versus Rajendra Singh Bhati) under Sections 406, 420 I.P.C. and 7/10 Pariksha Adhiniyam, P.S. Chandinagar, District Baghpat pending in the Court of Judicial Magistrate, Baghpat shall remain stayed and no coercive method will be adopted against the applicant during this period.
