Heard Sri Vikrant Rana, learned counsel for the applicant and learned A.G.A. for the State and perused the record.
The applicant is the mother-in-law of deceased. From the record, it transpires that the co-accused Rachit Rastogi (husband) and Anirudh Rastogi (father-in-law) have been acquitted after trial by Additional District and Sessions Judge, F.T.C. No. 17, Bulandshahr in Session Trial No. 182 of 2007 vide judgement and order dated 13.03.2007. Supplementary chargesheet has been submitted against the applicant.
It is submitted by learned counsel for the applicant that prosecution and trial of the applicant is barred by the principle of stare-decisis. A.G.A. wants time to argue on this point.

Till then, further proceedings of case no. 2040 of 2007 (State Vs. Smt. Prabha Devi) arising out of case crime no. 312/2006 under Section 498-A/304-B I.P.C. and ¾ Dowry Prohibition Act, P.S. Syana, District Bulandshahar pending against the applicant in the Court of Chief Judicial Magistrate, Bulandshahar shall remain stayed.
