Heard Sri Anil Kumar Singh, learned counsel for the applicant and learned A.G.A. and also perused the record.
The applicant Rajmani alias Kulbul has been summoned to face the trial vide order dated 01.05.2007 passed by the Trial Court under the provisions of Section 319 Cr.P.C. in Session Trial No. 113/2004 (State Vs. Ajeet Kumar and others) arising out of case crime No. C-6/2003 under Sections 307/34, 325/34, 504 I.P.C. P.S. Nevariya, District Jaunpur. It is submitted by learned counsel for the applicant that in the NCR, which was lodged by Smt. Munni Devi, the applicant was not named and chargesheet also has not been summoned against him, but in the Court in her statement, Smt. Munni Devi has named the applicant for the first time.
Having gone through the record, it transpires that there is evidence of two witnesses namely Munni Devi and Sheetla Prasad against the applicant. Hence, interference by this Court in the impugned order is not warranted.
In the result, the application under Section 482 Cr.P.C. is hereby rejected. However, the Court below is directed to decide the bail application of the applicant expeditiously as and when moved.
