Heard Sri Pradeep Saxena, learned counsel for the applicants and learned A.G.A.
It is submitted by learned counsel for the applicants that there are chances to settle the dispute amicably out of the Court and hence, the matter should be referred to Reconciliation and Mediator Centre, High Court, Allahabad.
The dispute seems to be husband and wife. In the interest of justice, I consider it appropriate to give both the parties a chance to settle their differences by resorting to the proceedings of reconciliation and mediation.
Let the record of this case be put up before the Registrar, Reconciliation and Mediation Centre, High Court, Allahabad, who will issue notice to both the parties fixing a date to personally appear before him and will then refer the matter for reconciliatory proceedings.
The conciliator is allowed three months time to go into the conciliatory proceedings between the parties.
The case will be listed before the appropriate Bench in the first week of October, 2007 along with the report of conciliator.
Meanwhile, further proceedings in case no. 4168 of 2006 (State Vs. Nafees and others) pending before 2nd Judicial Magistrate, District Badaun in case crime No. 5 of 2006 under Sections 498-A, 323 504 I.P.C. and ¾ D.P. Act, P.S. Kotwali Noida, District Badaun shall remain stayed.
