Memo of appearance has been filed by Sri Samir Jain, Advocate on behalf of opposite party no. 2.
Heard Sri Shashi Bhushan, learned counsel for the applicant, learned A.G.A. for the State and Sri Samir Jain, learned counsel for opposite party no. 2 and also perused the record.
Application under Section 482 Cr.P.C. has been moved to quash the chargesheet of case crime No. 599-A of 206 under Sections 147, 323, 504, 506 I.P.C., P.S. Cholapur, District Varanasi.
It is submitted by learned counsel for the applicant that false case has been registered and no case is made out against the applicant.
Having heard parties' counsel and after going through the material on record, there is no ground to quash the chargesheet, because there is prima facie evidence to proceed against the applicant-accused.
Hence, the application under Section 482 Cr.P.C. is hereby rejected.
However, the Court concerned is hereby directed to decide the bail application of the applicant as and when moved after making surrender in the Court as expeditiously as possible having regard to the observations made by seven Judges' Bench of this Court in the case of Amrawati and another Versus State of U.P. [2004(50) ACC 742].
