Heard Sri Manish Tiwary, learned counsel for the applicants and learned A.G.A. and also perused the record.
It is submitted by learned counsel for the applicants that there is no evidence against the applicants and summoning the applicants is abuse of the process of Court.
Issue notice to opposite party No. 2, who may file counter affidavit within four weeks. Rejoinder affidavit may be filed within two weeks thereafter.
List on 14.08.2007.
Till then, further proceedings against the applicants in Session Trial No. 282 of 2005 (State versus Kripa Shankar Tiwari) under Sections 498-A, 304-B, I.P.C. and Section ¾ D.P. Act, P.S. Atrauliya, District Azamgarh pending in the Court of Additional Sessions Judge/Fast Track Court No. (1) District Azamgarh shall remain stayed.
