The petitioner is an accused in case no. 5910 of 2006 State vs. Manjeet Singh pending before 1st Additional Chief Judicial Magistrate, Saharanpur. He has filed this petition with the prayer for quashing of the charge sheet filed against him the said case.
Having heard learned counsel for the parties and considering the facts and circumstances of this case, in my view, quashing of the proceedings of the criminal case is not warranted. However, in the facts of this case, this petition is finally disposed of with the direction that the petitioner is permitted to file objections through counsel till the stage of framing of charges and may not be required to be present in person till framing of charges, if any. It is further provided that the Court concerned shall not grant any unnecessary adjournment to the petitioner and decide the matter expeditiously.
With the aforesaid observations/directions, this petition is finally disposed of.
